Terms & Conditions
These Terms & Conditions ("Terms") govern your access to and use of the website mondoir.art and the products and services provided by Mondoir Gallery ("Mondoir", "we", "us"), located at Sheikh Mohammed bin Rashid Boulevard, Downtown Dubai, United Arab Emirates. By using mondoir.art or purchasing from us, you agree to these Terms.
About Mondoir
Mondoir is a contemporary art gallery and global online marketplace selling original paintings, sculptures, photography, prints, and editions by emerging and established artists. Mondoir also operates the Partner Studio consignment program, art valuation, sourcing, and consulting services. Our physical gallery is located in Downtown Dubai, UAE.
Pricing & Currency
All prices are listed in US Dollars (USD) by default unless otherwise indicated, and are inclusive of standard packing. Shipping, insurance, and any applicable taxes or duties are calculated at checkout or at point of import. We reserve the right to correct pricing errors at any time before order acceptance.
Payment
Mondoir accepts major credit and debit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, and bank transfer for high-value works. Payments are processed by Stripe under PCI-DSS Level 1 security. For escrow-protected purchases above USD 25,000, contact gm@mondoir.art for arrangement.
Order Acceptance
An order is a binding offer to purchase. Mondoir reserves the right to accept or decline any order, in whole or in part, including in cases of suspected fraud, pricing errors, stock unavailability, or shipping restrictions. If we decline your order, we will refund your payment in full within 5 business days.
Authenticity & Provenance
Every original artwork sold by Mondoir is guaranteed authentic and is accompanied by a Certificate of Authenticity issued either by the artist, the artist's estate, or Mondoir's curatorial team. We rely on information provided by artists, consignors, and prior owners to establish provenance. Buyers wishing to commission an independent expert appraisal may do so within 14 days of delivery; if the artwork is determined inauthentic as described, Mondoir will issue a full refund per our Return Policy.
Shipping & Returns
Shipping terms are described in our Shipping Policy. Returns and refunds are governed by our Return & Refund Policy, including a 14-day return window from delivery. Both policies are incorporated into and form part of these Terms.
Intellectual Property
Purchase of an artwork transfers ownership of the physical object only. Copyright, reproduction rights, and moral rights remain with the artist. Buyers may display the artwork privately and resell the original physical work; commercial reproduction, derivative works, or any use of artist images for promotional purposes requires separate written permission. All content on mondoir.art (text, photography, JSON-LD data, code) is protected by copyright and may not be reproduced without written permission.
Partner Studio (Artists)
Artists accepted into the Partner Studio consignment program are bound by the separate Partner Studio Agreement signed during onboarding, which sets commission, payout, exclusivity, content, and termination terms. The Partner Studio Agreement supersedes these Terms only with respect to the artist-Mondoir relationship.
Limitation of Liability
To the maximum extent permitted by law, Mondoir's total liability arising out of or relating to any purchase, the use of mondoir.art, or these Terms is limited to the amount you paid for the artwork or service in question. Mondoir is not liable for indirect, incidental, consequential, or punitive damages.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms shall first be addressed in good faith between the parties; failing resolution, the dispute shall be submitted to the exclusive jurisdiction of the courts of Dubai, UAE. Buyers in jurisdictions whose mandatory consumer-protection laws apply retain those statutory rights.
Changes to These Terms
Mondoir may update these Terms from time to time. The current version is always available at mondoir.art/terms. Continued use of the site or placement of an order after a change constitutes acceptance of the revised Terms.
